Terms of Service

These Terms of Service ("Terms") are an agreement between you and Designed By Fetch ("we", "us", "our"), a small business owned and operated by Mike Montpetit in Ottawa, Ontario, Canada. They govern your use of the Designed By Fetch website and service at designedbyfetch.com (the "Service").

By creating an account or using the Service, you agree to these Terms. If you do not agree with them, please do not use the Service. If you use the Service on behalf of a business, you confirm that you have the authority to accept these Terms on its behalf.

Designed By Fetch is an AI-assisted design tool for makers. You describe a subject, choose a Prompt Blueprint or Responsive Template, and the Service generates design images that you can prepare for UV printers, laser engravers, sublimation, and similar production methods.

Generated designs vary with your inputs and the state of the underlying AI models. Outputs are provided as-is, and we recommend previewing every design on your actual material before running a production batch.

You need an account to generate designs. You are responsible for keeping your login credentials confidential and for all activity that happens under your account.

You must be at least 13 years old (or the minimum age of digital consent in your jurisdiction, whichever is higher) to create an account. If you are under 18, you may use the Service only with the knowledge and permission of a parent or guardian.

Generating designs costs credits. New accounts receive a small number of free credits to try the Service. Paid plans include a monthly credit allowance, are billed in Canadian dollars, and renew automatically until you cancel them. Plan details, credit allowances, and prices are as described on the Pricing page at the time you subscribe.

You can cancel a subscription at any time from your Account page. Cancellation stops future renewals; it does not refund the current billing period. Prepaid credits and subscription fees are non-refundable, except where a refund is required by applicable law. If a charge looks wrong, email me and we will sort it out.

You retain the rights to the designs you create with the Service and may use them for personal and commercial projects, including products you sell.

You are responsible for the material you feed into the Service. Do not upload reference images you do not have the rights to use — for example, photos of people who have not consented, other artists' work you do not own, or trademarked characters and logos — and do not use the Service to infringe third-party rights.

Designs you explicitly share to the Community Gallery may be displayed on the Service. Designs you do not share stay private to your account.

You agree not to use the Service to create or distribute content that is unlawful, hateful, harassing, sexually explicit involving minors, deceptive, or that impersonates or defames others, and not to use it to produce counterfeits or infringing merchandise.

You also agree not to share your account credentials, resell access to the Service, run automated bulk generation that bypasses credit limits, or attempt to circumvent the Service's security controls. We may suspend or terminate accounts that violate these rules.

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that the Service will be uninterrupted, error-free, or that every generated design will meet your expectations. AI models can produce imperfect, inaccurate, or unexpected results.

The Service relies on third-party providers. Image generation runs on Google Cloud (Vertex AI), payments are processed by Stripe, and data is hosted on Supabase. Their own terms and privacy policies govern those services. We do not control them and are not responsible for their actions.

To the maximum extent permitted by applicable law, Designed By Fetch and its owner will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or materials (including wasted printer media or production time).

Our total aggregate liability arising out of or relating to the Service is limited to the amount you paid us in the twelve (12) months preceding the claim.

We may modify or discontinue any part of the Service at any time, including Prompt Blueprints, Responsive Templates, and available styles.

We may update these Terms from time to time. When we make material changes, we will notify you by email or in the Service. Your continued use of the Service after the changes take effect means you accept the updated Terms. The "Last updated" date at the top of this page always reflects the current version.

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada, and any disputes will be resolved in the courts of Ontario, Canada.
